$2.5 Million Jury Verdict for Failure to Monitor Post Surgery Hernia Operation

Margaret Parr, 68, underwent a hiatal hernia repair done by Dr. Medhat Allam. She was discharged several hours after the surgery. That night and the next morning, she suffered severe pain and was brought to another hospital where she underwent a second surgery, which revealed necrosis of her gallbladder, intestines, pancreas and stomach.

Unfortunately, Parr later died of ischemia resulting from thrombosis that had compromised one or more of the stents that been implanted in her celiac and mesenteric artery the year before.

Parr was a retiree and survived by her wife and adult daughter.

Parr’s wife, individually, and on behalf of her estate, sued Dr. Allam and his employer, alleging that he chose not to properly monitor Parr and for wrongfully discontinuing her anticoagulant and antiplatelet medication before the surgery.

The lawsuit also alleged that Dr. Allam had failed to consult a vascular surgeon about Parr’s complicated condition or order a radiological study of the implanted stents. Parr, who had significant risk of post-surgical complications, should not have been discharged until the day after the surgery, the Parr family argued.

The jury signed a verdict for $2.5 million.

At trial, the plaintiffs presented experts in vascular surgery and surgery.

The defendants presented experts in the same fields, vascular surgery and surgery.
